The purpose of this website is to inform you of a proposed settlement involving Heartland Payment Systems, Inc. (“Heartland,” or “Defendant”) in a class action lawsuit involving an unauthorized intrusion into Heartland’s payment processing system. The people who sued are called the “Plaintiffs,” and the company they sued, Heartland, is called the “Defendant.” Heartland is a company that processes credit and debit card transactions for merchants whose customers use credit and debit cards.

The lawsuit challenges Heartland's protection of the consumer credit and debit card information processed though Heartland, which was attacked by criminal intruders in 2008. Plaintiffs claim that Defendant failed to adequately safeguard its computer system and, as a result, unauthorized people gained access to consumers' credit and debit card account information. According to Plaintiffs, Heartland’s inadequate security measures allowed unauthorized people to access and steal this information to commit fraud and identity theft.

The Court did not decide in favor of Plaintiffs or Defendant. Instead, both sides agreed to settle this case to avoid the cost and risk of a trial. The proposed settlement does not mean that any law was violated or that Defendant did anything wrong. Defendant denies all of Plaintiffs’ claims in this case. The Class Representatives and their lawyers think the proposed settlement is best for the Settlement Class. The Court has preliminarily approved the proposed settlement.

If the proposed settlement is ultimately approved, reimbursements for certain losses will be given to everyone who submits a valid and timely claim. This website explains the lawsuit, the proposed settlement, your legal rights, what benefits are available, who may be eligible for those benefits, and how to get them.

Judge Lee H. Rosenthal of the United States District Court for the Southern District of Texas is overseeing this consolidated class action. The case is known as In re Heartland Payment Systems, Inc. Data Security Breach Litigation, Civil Action No. 4:09-MD-2046.
